(Grounds Permit)
The Regional District does not make any warranties or representations about the suitability, for the Permit Holder's purposes, or about the condition of the Grounds for which this Permit is issued. In particular, the Grounds do not receive daily care or inspection. It is the Permit Holder's responsibility to inspect all the Grounds for which this Permit is issued and to ensure that the lands are suitable and safe for the Permit Holder's purposes.
The Permit Holder
may use only the Permit Area named in this Permit;
must not allow another person to use the Permit Area;
must exercise the greatest care in using the Permit Area;
must immediately report to the Regional District's Animal Shelter all damages to the Permit Area that the Permit Holder causes;
must compensate the Regional District for all damages that the Permit Holder causes to the Permit Area;
must leave the Permit Area in a clean and tidy condition after using it, or compensate the Regional District for the cost of doing that;
may place an object in or on a grass field only after consulting with and following the directions of the Regional District's Animal Shelter staff for the purpose of avoiding damage to underground utilities;
must notify the Regional District's Animal Shelter to cancel this Permit if the Permit Holder does not intend to use the Permit Area for which this Permit is issued in accordance with the cancellation policy contained in this Permit.
The Permit Holder agrees to use the Permit Area at its own risk and to indemnify and save harmless the Regional District and its elected and appointed officials, officers, employees, agents and contractors from all claims, losses, costs and damages including proceedings and expenses resulting from bodily injury, including death, to any person or persons, or for damage to the property of others, that arise directly or indirectly in connection with the use or occupation
of the Grounds and Permit Area by the Permit Holder its quests, members and invitees.
The Permit Holder may be required to maintain general liability insurance coverage for the purposes of indemnifying the Regional District on the following bases:
the Regional District will be covered as an additional named insured;
the insurance policy will contain a cross liability clause;
the insurance policy will be written on a comprehensive basis with inclusive limits of not less than $2 million per occurrence, including $2 million for bodily injury and death to one or more persons, or for property damage, occurring on, in, or about the Permit Area during the time for which this Permit is issued;
the insurance policy will contain a clause providing that the insurer will give to the Regional District 30 days prior written notice of a cancellation of insurance and of any important change to the coverage;
the Permit Holder will give to the Regional District an executed copy of a Certificate of Insurance as evidence of the coverage.
The Permit Holder is responsible for all costs associated with this event including but not limited to all equipment supplied, additional staffing, setups and take downs, cleanup, facility damages, technicians, ticket printing and sales, unless otherwise agreed.
The Permit Holder shall comply and ensure compliance with Provincial burning and campfire bans and regulations.
The Permit Holder agrees to start and end their event according to the times indicated in this Permit. Failure to do so will result in additional charges.
CANCELLATION POLICY
For bookings up to 3 hours in duration including preparation - cancellation in writing must be made a minimum of 4 working days in advance, otherwise, the Permit Holder will be required to pay the full rental fee.
For bookings greater than 3 hours in duration including preparation - cancellation in writing must be received a minimum of 90 days in advance, otherwise, the Permit Holder will be required to pay 50% of the rental fee, plus any costs incurred by the Regional District in relation to the booking. A deposit as determined by the supervisor will be paid at the time of this booking.
Bookings made where there is less than the minimum cancellation time period before the event will require payment by cash or credit card at the time of booking.
The Permit Holder shall not assign or sub-let the whole or any part of the Permit Area.
The Permit Holder covenants to pay all fees, licences, taxes and tariffs of the Society of Composers, Authors and Music Publishers of Canada where applicable.
The Permit Holder covenants to abide by all bylaws, ordinances and regulations, and in particular, covenants that it will not suffer or permit alcohol to be had or consumed on the Permit Area, unless a lawful licence therefore shall first have been procured.
Unless otherwise agreed, nothing contained in this Permit shall be construed as an undertaking or agreement by the Regional District to provide or maintain for the benefit of the Permit Holder any equipment or personnel or to undertake any maintenance, janitor service or other works or like nature during the Permit Holder's use and occupation of the Permit Area.
Nothing contained in this Permit shall take effect as or constitute a warranty or guarantee by the Regional District as to the fitness, availability or condition of the said premises or the fixtures and fittings herein or of any equipment given, loaned or rented by the Regional District to the Permit Holder independently of this Permit.
If the bylaw, fire, or police departments determine the Traffic Control Plan or Event Security Plan is inadequate the Regional District may require the Permit Holder to change those plans so they are adequate to the fire and police departments.
The Permit Holder shall not permit anything to be brought on or any act done on the Permit Area that would invalidate or increase the premium on policies of insurance held by the Regional District or which may injure or deface the Grounds.
The Permit Holder shall not construct, erect or attach any fixtures of any kind to any part of the Permit Area, without the written consent of the Regional District and if so erected, the Permit Holder covenants to remove the same and restore and leave the Permit Area in the same condition it was in at the time the Permit Holder entered into occupation. If such restoration is not to the satisfaction of the Regional District, all such repairs are to be carried out by the Regional District and all costs involved are to be paid by the Permit Holder.
The Permit Holder shall indemnify and save harmless and keep indemnified the Regional District from all liability for any loss or damages to any property of the Regional District during or occasioned by the occupancy of the Permit Area save and except reasonable wear and tear.
Waiver of one or more terms of this Permit shall not be thereafter deemed a modification or waiver of the entire Permit but other terms and conditions shall remain in full force and effect.
The Permit Holder agrees that in the event of any strike or lockout, the Regional District will not be held responsible or liable for providing said facilities.
The Permit Holder understands that the Regional District may revoke or cancel the Permit with cause.
